COVID-19 Construction Industry Update

As Miami-Dade County and the rest of the State of Florida temporarily shut down “non-essential” businesses, many clients are asking how this impacts their construction industry business. As of today, based on Miami-Dade County Emergency Order 07-20, the following forms of business are defined as “Essential Business” that may remain open without restriction: “contractors and other tradesmen, open construction sites irrespective of the type of construction project, architects, engineers and land surveyors.”


As such, there is no restriction currently in place preventing construction industry firms from operating. However, each company has its own specific concerns and issues that may impact its decision of whether to remain in operation or to suspend some or all operations, including employee safety and health, client/lender funding issues, building department restrictions, client safety and health, financial considerations, etc.

Each company will also have unique contract considerations that will impact their determination. For instance, is the Coronavirus considered a “force majeure” event that would excuse any delays resulting from suspension of work?
