SKS Obtains $1.665M Arbitration Award for Yacht Club Client in Design Error Case

SKS Legal Group, led by managing partner, Jordan C. Kay, and partner, Justin S. Miller, after an 18 month binding Arbitration proceeding that ended with a 5 day final hearing, obtained a $1.665M Arbitration Award in favor of its client, a prominent South Florida Yacht Club, in a case brought by the Club against its architect that designed its new yacht club building and recreational facilities. The case involved a number of design errors and omissions in connection with rooftop mechanical equipment, design conflicts that resulted in a series of changes and increased costs, structural and foundation errors resulting in substantial re-design, and the withholding of a permanent certificate of occupancy by the authority having jurisdiction as a result of the violation of local ordinances. The Yacht Club was ultimately named the prevailing party despite the case also including a counterclaim brought by the architect.
